Terms and Conditions
  1. Talbot Laboratories (Pty) Ltd is a SANAS Accredited Testing T0122 and ISO 9001 certified Laboratory, Relevant certificates are available on the SANAS website or alternatively can be provided on request.
  2. Prices indicate whether VAT is included or excluded. Discount percentages may be approximate due to rounding of cents.
  3. A pro rata minimum charge of up to R800.00 (excl. VAT) is levied for all order values less than R1,500.00 (excl. VAT) per job.
  4. Client self-quotes are validated upon receipt of a Talbot quotation number according to our Lead Log. We strongly advise self-quotes be validated prior to sample receipt at the Laboratories. Self-quoting prices may be subject to change, for example sample preparations, if these costs are accidentally omitted by the client.
  5. Quotations note analytical turn-around times. All turn-around times are working days, excluding weekends and public holidays. Our KZN Laboratory is open from 6am – 6pm Monday to Friday. All samples will be processed should the relevant paperwork be available if they arrive at the laboratory before 4h45pm. The Gauteng Laboratory and Port Elizabeth Depot are open from 8am – 04:30pm Monday to Friday. Clients to exercise caution for courier/deliveries day before weekends / public holidays.
  6. Turn-around times may vary where clients do not provide Sample Submission Sheets / Chains of Custody forms; necessary sample matrix or contamination (interference); or other information such as waste SDSs.
  7. Sub-contracted turn-around times are subject to third party control and events unforeseen and outside of our control.
  8. Where unforeseen circumstances prevent analysis, sampling, collection or couriering, Talbot will not be held liable. We will inform clients of the unforeseen circumstances as soon as it is safe and possible to do so, and discuss alternative arrangements with the client.
  9. Priority turn-around time is offered at an additional surcharge fee depending on the requirement, which is to be discussed with the laboratory.
  10. Non-accredited and Sub-contracted analyses are indicated on the Certificate of Analysis. Clients are responsible for ensuring any other special reporting requests are made prior to analysis. Changes involving additional analyses or work may incur additional charges.
  11. If a sample result is repeated on request, the following charges apply:
    • Should the repeat confirm the original result, the value of the repeat test is charged on the invoice.
    • Should the repeat provide a different result, there will be no charge.
  12. All sample bottles (’empties’) not returned or broken will be charged for. Where sample bottles are provided free of charge (non-expedited courier), this is within South Africa and where quotes exceed our minimum order value noted above.
  13. Samples should be kept as cold as possible and delivered to the lab on the same day as sampling unless otherwise agreed or extended holding times apply.
  14. All samples are disposed of without notice and according to our waste disposal policy 1 week after the report has been issued: chemistry and waste classification samples, 1 week; microbiology samples, 1 week.
  15. All waste samples are disposed of without notice 1 week after our report has been issued, according to the laboratory waste disposal policy. Alternatively, waste samples can be returned at the client’s cost and upon receipt of client request to do so. Each sample disposed of by the laboratory will incur a client charge of R350.00 (excl. VAT).
  16. Prices are quoted subject to our sample matrix policy for analyses offered in-house.
  17. Should a sample matrix be such that we need to subcontract to a peer laboratory, please note that you will be informed. Quoted prices in such cases are subject to change.
  18. Prices for sub-contracted analyses are quoted subject to the agreement of the laboratory sample matrix policy for receiving samples. Should a sample matrix be such that it cannot be accepted by our standard sub-contractor laboratory and needs to be sub-contracted to an alternative peer laboratory, you will be informed of this change. In addition, should this subsequently affect the quoted price, you will be informed. Sub-contracting laboratory methods, reporting units, detection limits etc are subject to change without prior notice or Talbot liability.
  19. Chlorine, pH, and temperature should be done on site whilst sampling. If requested in the laboratory, these are measured within 2hrs of lab receipt provided all requisite information is supplied by the client. Results may be indicative and should not necessarily be regarded as representative of site conditions. If done on site by our sampling officer, the result is reliable.
  20. Work will only commence work once an order no. or written confirmation is provided. Analysis and invoicing will reflect the relevant quotation.
  21. New Clients and Prepaid Clients are required to make payment upfront before results are released. Payment may be requested prior to start of analysis, or sample collection from site (i.e. couriering).
  22. Customer Take On Form must be completed with all relevant client details.
  23. Please also complete the credit application form should a credit account be required.
  24. Discount rates can be negotiated. Discount is negotiated based on the number of samples or the value of work applicable to the project. Discount is subject to change should the original quantity or value of work deviate from the original agreement.
  25. If the order is cancelled, any work already carried out before date of cancellation will be invoiced for.
  26. Prices and information herein are subject to change without prior notification.
  27. Payment is due within thirty (30) days from the date of the statement unless alternative arrangements have been mutually agreed upon.
  28. Failure to meet payment terms will result in accruing interest at the prime lending rate.
  29. Settlement discount is not applicable.
  30. Quotations are valid for thirty (30) days (unless otherwise stated).
  31. We are not liable for any errors or omissions arising from the use of this lab pack, but will do our best to resolve any such issues to the benefit of all parties.
  32. Clients must ensure sample packing does not result in volume loss which may affect our ability to analyse the selected determinands. We will not be responsible for insufficient volumes affecting the chosen analytical regime.
  33. All information regarding the type of samples submitted by the client must be revealed, including sample source, type, and KNOWN OR POTENTIAL HAZARDS explicitly stated for the safety of our people and facilities. Failure to do so may invalidate accreditations, and/or incur additional preparation, analysis or

  38. All statements of conformity for comparisons against any specification will be based on the laboratory decision rule unless agreed to in writing prior to start of analysis. Contact us if you require specific criteria or would like to discuss the decision rule further.
  39. Forex quotes will be charged at the given rate herein regardless of actual exchange rate at time of invoicing or payment.
  40. Waste Assessments, Classifications and Safety Data Sheets (SDS) are based on, inter alia: analyses selected by the client; client information on waste stream use, source and composition; evidence and subjective judgement; and any other information available at the time of assessment including third party information where deemed necessary. Talbot is not liable for assessment, classification, or SDS conclusions. Conclusions based on limited analyses and/or without client waste stream information may not be complete. New waste information is to be provided to Talbot immediately on identification as this may affect classification conclusions.
  41. Partial GN R635 chemical waste analysis will preclude assessment of that waste stream from Type 4 (Class D) disposal to landfill. Type 3 (Class C) will be the lowest possible general waste type conclusion.
  42. With the exception of pH, and Flash Point for liquid wastes, Talbot does not classify physical hazards per SANS 10234 or 10228 unless specifically requested by clients, and available from third party sources.

The Data Subject consents to the storage, processing and collation of Personal Information by Talbot, from their Data Subjects (as defined by POPIA), in compliance with the Act.

It is the responsibility of the Data Subject to ensure that they always remain compliant with the provisions of POPIA.

At all times it is the responsibility of the Data Subject to update Talbot of any changes to any personal information held and ensure the information held is accurate, not misleading and is complete in all respects.

By providing Personal Information to Talbot and/or its Operator(s), the Data Subject consents to the processing and further processing of the Data Subject’s Personal Information for the purpose as and where required and the Data Subject understands the purposes for which the Personal Information is required and for which it will be used for.
